Scrap sedition laws

When I was a young boy, I assumed, very naturally, that I was extremely patriotic.   Singing the national song and national anthem gave me goose bumps (it does even now), and the very idea of dying for one’s country was a heroic and romantic notion, something I thought I would do without hesitating for a moment.   But then I ‘grew up’.  

The unfortunate consequence of ‘growing up’ is that you are no longer innocent.  You know more than what normally appears.  [I put 'growing up' in quotes because not everyone who lives longer actually grows up.  Most people, I realize, stop growing at around 16 or 17.  They carry their prejudices from then on defending them for the rest of their lives.]

Now, I realize that there are two versions of patriotism.  The first is the love of one’s homeland, which is natural to most people.  We are nostalgic and have an attachment towards one’s origins; either it is a place of birth, or the times when we were young.  We reminisce the moments of the past with longing and feel attached to them.   

Almost every human being will try to protect one’s home against onslaught of the invaders.  One’s home could be just one’s house, one’s street, one’s village, one’s district, one’s region, one’s state, one’s country, or one’s planet.   The definition of home itself changes depending on who the invader is.  If the neighbor tried to encroach upon what rightfully belongs to you, your home is just your house and you fight for it.   But when aliens invade us, then our home is our planet and we fight for the planet. 

If the definition of patriotism is love of one’s home and feeling to defend it from the invaders, then it is completely natural to most human beings to be patriotic.  I think I am a patriot from this definition.  I take pride in fighting for my people as long as I think it is a fight for justice.  I also feel that I should express solidarity with those who fight for their people as long as I think it is a fight for justice.

However, if patriotism is the feeling that my country is the greatest and that it can never do anything wrong, then it is based in sheer arrogance coming out of absolute ignorance.   It is this arrogance based in ignorance that makes me think that my nation, my religion, my race is the greatest just because I am born into it.  I am NOT this kind of a patriot.

If patriotism means I have to give up my rights to criticize the nation I live in, then I am no patriot.   A modern constitutional democracy should allow its citizens to criticize the nation, its actions, its policies, its misadventures, its treatment of its people.  That’s an essential ingredient of such modern nations.  To deny such freedom is to convert that nation into autocracy, moving it back in time, and making witch hunting legal. 

Expression is not always agreeable to everyone.  We cannot limit our freedoms to only the agreeable expressions and prosecute those who make disagreeable expressions.   A nation granting its people freedom of expression comes with responsibility and maturity to handle criticisms, insults, words of hatred and abuses.  The question is: are we that mature?

Sedition case against Arundhati Roy

Arundhati Roy, author and columnist, is charged under sedition laws for the remarks she made in a seminar titled ‘Azadi – the only way’.  She said that ‘Kashmir was never an integral part of India’.  Arundhati Roy has voiced her thoughts and opinions on the status of Kashmir in India, lending voice to millions of Kashmiri’s demand of freedom from India and is now booked under laws that come from colonial times.  She is slapped with Sections 124 A of Indian Penal Code along with host other sections.

What is sedition anyway?  According to IPC Sec 124 A:

Whoever, by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards the Government established by law in India, shall be punished with imprisonment for life, to which fine may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.

Explanation 1-The expression "disaffection" includes disloyalty and all feelings of enmity.
Explanation 2-Comments expressing disapprobation of the measures of the attempting to excite hatred, contempt or disaffection, do not constitute an offence under this section.
Explanation 3-Comments expressing disapprobation of the administrative or other action of the Government without exciting or attempting to excite hatred, contempt or disaffection, do not constitute an offence under this section.

See how loosely this is worded.  ‘Whoever, by words, either spoken or written, attempts to excite disaffection towards the Government established by law in India, shall be punished with imprisonment for life.’  That includes almost every criticism of India.  Almost anyone who is unhappy with the way India is performing and therefore goes about criticizing it can be charged with sedition.

So, how did this law come into picture? 

It was inherited from the British who used this law against all our freedom fighters.  This law was the reason why so many of our freedoms fighters languished in jails half of their lifetimes.  As freedom fighters we fought against this law when we were under British, but for some reason when we toppled our masters, we became the masters and decided that very such activities used by our freedom fighters under British rule have suddenly become illegal overnight because now we have replaced the British.  Instead of scrapping this law completely, we replaced the words ‘Her Majesty’ and ‘Crown Representative’ with the Government of India.  Isn’t this clear how we see ourselves, as replacers of the Crown, as rulers, but not as the elected representatives of the people?

How can a democracy not allow its people to express disaffection?  What is hatred?  Is anger towards your own government considered hatred and enmity?  Is higher expectation of your own state considered disaffection and contempt towards your state?

If that is the case, every fight that took place in India after 1947 can be described as seditious.  Every attempt of the opposition party which criticizes and berates the governments, stalls the proceedings of the state machinery, brings it to a halt, and then deliberately ensures the government falls, can be described as seditious.   The fight for Andhra State by Potti Sriramulu is seditious.  The fight for Gujarat from Bombay State is seditious.  The struggle carried out by opposition parties under the leadership of Jayaprakash Narayan against the dictatorial regime of Indira Gandhi is seditious.  

The fight carried out by Jayaprakash Narayan is hailed as a fight to restore democracy, but each and every action of theirs was calling for disaffection with the Government of India, exhorting people to openly work against the Government of India, by being uncooperative, by expressing anger (which can easily be construed as hatred), by expressing disenchantment (which can easily be construed as enmity), with an explicit agenda of ensuring the government is destabilized, falls, so that they can come and take over the power.  All of which constitute real cases for sedition charges.  The actions carried out by BJP when Congress is in power, and the actions carried out Congress when BJP is in power are all seditious.

The fight of Telanganas is seditious too.  They openly criticize the government of AP, express anger towards it, and are completely disenchanted by the government in power.  They believe that the government is undemocratic, that they are not represented well in the government and therefore work towards creating a new state called Telangana.  There are nearly 30 Million people in Telangana who can be charged with sedition.  Not to count the numerous number of people who protest against the scandalous regimes in Maharastra or Karnataka.  They can all be booked under sedition laws.  

How can a personal opinion be seditious however disagreeable it is? What times are we living in?  Shall we bring back witch hunting, use evidences of witnessing the perpetrators flying on their brooms? 

According to Arundhati Roy:

…a TV journalist asked me "Madam is Kashmir an integral part of India or not? I replied that Kashmir was never been an integral part of India.

Here the word ‘integral’ itself has many meanings.  If someone came to me and asked, ‘do you think India is truly secular?’ there is a good chance I would say, ‘It is not’.  My answer depends on the context.  I know very well that Indian Constitution says we are secular, but when I say we are not, I am conveying my opinion that we in India do not follow secular principles in our actions.   Does my statement, ‘India is not secular’, constitute sedition?

If someone came to a political scientist and asked, ‘do you think India is socialist?’, he may say, ‘we are not socialist, because…’  Whatever he says after that is irrelevant.  The fact that he said India is not socialist is good enough for him to be booked under the laws of sedition, because he spoke something that is disagreeing with our constitution. 

Arundhati Roy may have felt, through her observations in Kashmir, that Kashmiris never felt they were part of India, and therefore she could easily say, ‘Kashmir has never been an integral part of India’.  There could be many reasons why she thinks that way.  Maybe, it’s because she has seen how Kashmiris feel about India, or because she has read history enough to understand the nuances of accession of Kashmir into the Indian Union, maybe she is being poetic, maybe she is ranting, maybe she is angry with India, may she is delusional.  It really doesn’t matter what state of mind she is in.  She is entitled to an opinion and she is being denied one here because we are so insecure a nation that we feel threatened by a lady who expresses her opinion candidly without fear of persecution.  By persecuting her we are actually proving it to the world how insecure we are, how unjust we are, how we are capable of suppressing people’s rights and voices, how we can bulldoze people into submission, how we can deny freedoms to our own people, the same accusations that Kashmiris make against India.

By charging Arundhati Roy with sedition, so that we shut her up, we are vindicating what every Kashmiri is saying against India in Kashmir Valley.  We are a bully who will not hesitate to deny people their freedoms to cover up our insecurities as a nation.  In fact, India can put every Kashmiri in jail because almost everyone shouts 'Azadi' in that valley.

In addition to the above charges, Arundhati Roy is slapped with Section 153 A (promoting enmity between two communities), Section 153 B (assertion against national integration), Section 504 (intentional insult with intent to provoke breach of the peace) and Section 505 (statements conducing to public mischief). 

I am not sure who came up with these laws and why they continue to exist.  There are laws in Indian Penal Code against kite-flying, against taking pictures from the air and so on.  They exist so that anyone can use them against anyone at any point of time to settle scores.

So what did Arundhati Roy say that is making this nation tremble in fear?



People have their opinions and expressions.  Some people have higher expectations from their state and when they are not fulfilled, they take up struggle against the state.  That should not be confused with enmity or hatred.  It should be understood as anger towards the state which is nothing but natural feelings towards objects of authority when you are disenchanted with it. 

I may not agree with Arundhati Roy but she should have the right to express her views.  Otherwise we are a weak nation, an insecure nation, a nation which cannot defend the expressions and opinions of an individual.  Sedition laws are archaic, set in colonial times where governments were ready to pounce on people who voiced their thoughts and opinions against the state.  Such laws in a modern democracy do not make sense.  They will be used by politicians to settle scores, and by groups to punish individuals. 

I do not necessarily agree with Arundhati Roy on all issues.  In fact, I didn’t read any of her books.  But I am not going to use force or ask my nation to use force to shut her up.  If she is ready to criticize the nation, I call upon those who disagree with her to raise their voice and criticize her in return.  That does not mean we shut her up by force, file a case against her and put her in a jail.  India has a duty to set the right example by allowing Arundhati Roy to voice her opinion however disagreeable it is.  India should scrap this law completely and let people of India criticize their nation in their own way.  It is much better to let our people voice their anger than pushing them take up arms and fight the state the way the way so many militants are currently doing.

    In fact the government of India wouldn't have taken this issue seriously, if Arundhati Roy wasn't a renowned writer.

    Why not? Why shouldn't a citizen say whatever comes to mind? Why can’t he/she criticize one’s nation for its actions, policies, misadventures? Why should a citizen be cautious when criticizing one’s nation?

    Why should it matter if the person criticizing the nation is a ‘famous’ person or not. Shouldn't the laws of the land be applicable equally to everyone?

    I don’t compare our country with China. I compare it with its own vision which it has set forth when we formed this nation. The question is if are we living up to the principles we promised ourselves.

    Only an insecure nation trembles in fear when an ordinary individual speak his/her mind. A secure nation would not get go about prosecuting him/her for words of criticism.

    China is a good example that contradicts your statement.

    China is an insecure nation. It has to continuously arrest every detractor, opposition member, freedom activist, to keep the nation going.

Sujai I once heard you Say that we shouldnt take Arundhati or Medha patka Seriously, that they have some romantic Ideas but I totally Disagree I think their views are most realistic may be not to you and me but the 80% of the Silent Majority of Indians who earn less than 2o RS a day and who are Invisible to the Corporate media channels.

    I lost all respect I had to our national Song Vande matheram some two years ago when they forcefully made all Students to Sing Vandematram despite protests by Muslims.
    Our country today doesnot resemble Democracy, it more like The Mughal empire aka Gandhi empire, their regional Satraps run the provinces, the High command( what the hell is that ). Everyone licking the boots of High command like bowing before some Royal Highness.

  7. I think Right to Speech has to be suspended only when it Directly threatens national Security.

    example: Press reporting about army movements during a time of war or State secrets.

    Kashmiris are saying azadi from the past 50 years under sedition laws they all must be put behind bars technically.

    If the government is given the right to decide,what they think is against NATIONAL SECURITY,they would first scrap FREEDOM OF SPEECH AND EXPRESSION from the fundamental rights,since it does not suit their requirements.

    We suit our convenience,to discuss Kashmir,but there are millions suffering in the name of one country's pride and another's ego.

    As a nation,we don't hear their pleas and cries because we don't want to believe that we have done this to someone.

    A lot of them actually feel that we are'saving'them from Pakistan.

    INDIA IS IN COMPLETE DENIAL,OF WHAT HAPPENS AND WHAT IS HAPPENING IN KASHMIR IN THE NAME OF PATRIOTISM.

    And,when a whole nation is in denial,we do not even accept that there is a problem,how can we find solutions???

    The same is with the Telangana issue....

    Nobody wants to hear that the region is suffering from backwardness and discrimination.

    They ask,You have well developed cities,industries,infrastructure and what not????So,what discrimination are you talking about?????

    Like the government has conducted hand in glove white collar crimes here,it has done so in Kashmir in the name of Patriotism...

    China is weak. And it is insecure. The greatest threat to China comes not from outside like USA or India, but from its own people. That is why it had to imprison Liu Xiaobo for 11 years, hack google and facebook, commit Tiananmen etc. Liu wrote Charter 8.It is freely available on the net. Just go through it and see if there is anything remotely unpatriotic.

    Are we willing to let Indian government go the china way?

  13. I am of the opinion that Ms Roy or for that matter anyone should be able to express his/her views without fear, no matter how outlandish it may seem or sound. However, the state should also exercise its power to maintain law and order. Therefore, while it is right for Ms Roy to question the status of J&K in Indian union, the court is also right in allowing FIR to be lodged.

    The matter should neither be in the hands of conservatives, who heckled her in Delhi, nor it should be in the hands of liberals, who may go to the extend of allowing any state, any district of India to prepare for going out of the Indian union.

    It is reason which should prevail. Therefore, it is correct to have a court hearing on it and matter be decided in a non-emotive atmosphere.

  14. Freedom of Speech has its limits and Arundhati Roy was well within the limts. Some people like Lavanya Naively argue that we must have Unrestricted Freedom of Speech, well thats Stupid. Consider this your Kingdoms fort is Besieged and surrounded by your enemies, then if you Shout at the top of your voice about the Secret passage your "beheading" under sedition can be completely justified.
    And some people like Shravan are fanboys of Forums for Gossip like greatandhra.com just dont take idiots like them seriously.

    I think Kashmiri Pundits are Cowards and morons, they could have choosen to Stay back like Sikhs and if threatened take up arms. Instead they voluntarily chose to migrate to Jammu, few dozen random killings of Kashmiri Pundits doesnt justify for their Decision to migrate, if they had any love or longing for their Homeland Kashmir they would have stayed back and fought like Sikhs in kashmir.

  16. I wonder why Ms.Roy does not talk about the plight and Rights of Kashmiri Pandits. India has given special status to J&K in the constitution, something no proud democratic country in Europe or America would give to a state, province or region. Kashmir is the soul of India. Those who speak against this spirit are traitors and should be sent to the forsaken areas of AfPak.

    When India was partitioned with Pakistan, Gandhi and our founding fathers took a pledge, on our behalf, that the country will NEVER be broken again. If national security and integrity demands curtailing rights of criminals and trouble-makers, I am all for it. Go India.

    Your examples are quite childish to drive the point home.
    I never said,that a citizen could talk about or say whatever they wanted to,or for that matter anything that concerns national security.
    I only said that,she spoke about an incident where India has agreed that Kashmir was never a part of India,at an international forum.

    And,if the government has said so themselves,how could she be put in jail for speaking about it at a meeting.

    Sedition laws are outdated...period

    We cannot send away the Taslimas,
    Rushdies and the Hussains in the name of sedition just because they ask us embarrassing questions.

    And,our dear government has done this earlier,they would do it again,if it suits them.......

    Kasmiri pandits saw a whole lot of violence in their valley than we people can even imagine.Their migration did not happen in a day,month or year...
    There are decades of violence and trauma that has made them the way they are.Calling them,cowards and morons does not make them as such......

    Freedom of speech and shouting about your kingdom's secret passage are totally irrelevant comparisons.

    By the way you just called all the Kasmiri pandits cowards and morons,which may cause a fresh bout of violence in the country.So,technically you are causing a threat to national security.

    It is not a question of one Arundati expressing her views about Kashmir.
    We as a nation do not understand that we have robbed an entire state of its dignity of existence.

    We are in complete denial of what happens in Kashmir.

    If you think that the Indian Army has not crossed its limits to uphold our country's pride,you cannot be more wrong.....
    Every soldier who is posted there is treated like a hero,and every deed associated with patriotism.
    Any contradictory statement is considered anti establishment.

    We are not worried about the causes or consequences,we are only in it for pride.......

    You are only reflecting,what you have been fed through the different sources.
    You wouldn't understand fear,anger,humiliation or helpless-ness for your loved ones,if you have not experienced it yourself....
    And,things were very different a few decades ago.

    We took a beautiful valley and gave them entire generations of poverty, illiteracy,unemployment and what not in return......

    Krishna you are an Idiot so you chose not to listen, Arundhati roy spoke about rights of the Pandits during the Same so called sedetious speech titled "azadi the only way".

    Even europe has some Archaic laws for example displaying any Nazi Memorobilia or Denying Holocaust in France or Germany can earn you up to 3 years in Prison. That doesnt mean we should have Stupid laws.

    I heard that the Reason India didnt attack Pakistan after terroist attack on parliament, was that US issued a warning to all its citizens to evacuate India due to posibility of a nuclear war So our Corporations got Shocked that they are gonna loose business so they convinced the govt to stop the attack. Thats how much corporations control India.
    And Lavanya I think you are really Stupid, I hate "Activism" doing things for the Sake of being a non conformist exceptionalist. That Drains away the real purpose. You must not go to a Protest or say a bold statement like "India is fascist" just because it gets You HIGH . I prefer direct action like iam thinking of Throwing some MOLOTOVS for the D day.

    Your statement that you plan to use extremist measures shows your total lack of respect for human life(yours as well as others).
    Your MOLOTOVS against their tear gas bombs and eventual firing,will only aggravate the problem,instead of solving it.

    Any extreme emotional outburst will only give them a reason to fire and make the Telangana struggle lose several soldiers instead.

    And that they are WAITING for an excuse to fire,is no secret.

    Don't forget that the firing that caused several deaths in Basheerbagh a few years ago,didn't put a dent in the governments armour,except cause a few shuffles in the administration.

    There are too many Dyers'this time,and they are too smart to be making the first move....

    Did you start using your MOLOTOVS at every meeting that you have ever attended,without even trying other sensible options.

    Why shouldn't someone attend a meeting,to express their disagreement with the government on some issues???It is not a non confirmist attitude.It is their way of expressing solidarity to the cause.
    The Indian Army has committed several crimes in the name of patriotism in Kashmir.Just because it is the Indian Army,should we not stop them or question them????

    Even an idiot with basic understanding of weapons and tactics will know that Molotov cocktails cannot be thrown sitting in China.You would have to be in the same frame to do that,and end up risking everyone's life around.
